Madibeng to promulgate first traffic bylaws!
The Madibeng Municipality is finally getting its first traffic by-laws!
Madibeng Municipality has called for comments on the draft of the municipality’s first Traffic By-Law.
According to the draft, Madibeng has not had Traffic By-laws since the “dawn of democracy”, with the last promulgated by-laws published in 1949. “Such By-laws would never stand on the legality of the present day democratic government, thus, paving way for Madibeng to enact Traffic By-laws which will be consistent with the Constitution of SA, Municipal Systems Act 32 of 2000, North-West Road Traffic Act 11 of 1997 and NRTA,” the draft reads.
Besides traffic laws, the proposed by-laws will address among others, illegal signage, parking bays, public behaviour, pedestrians’ rights and a ban on hitchhiking. The draft also addresses nuisance violations such as urinating, spitting in public and public gambling.
And finally, noise nuisance will be addressed. The draft by-law proposes that:
No person shall in a public place –
(a) cause or permit to be caused a disturbance by shouting, screaming or making any other loud or persistent noise or sound, including amplified noise or sound; or
(b) permit noise from a private residence or business to be audible in a public place;
(c) unless such persons have a permit to use such loudhailers, amplifiers or loudspeakers to amplify the sound.
